1.5 Million Jury verdict for Railroad worker who sustained shoulder injury.

Plaintiff, a rail road worker, had just finished a repair job on pumps that removed water from the train tunnel under the Hudson River. Walking through the tunnel near the entrance to the station, he saw in the distance that a train was rapidly approaching. In an effort to avoid being struck by the train Plaintiff was forced to climb up a set of pipes where he eventually lost his grip, sustaining injuries and tearing his rotator cuff.

Mr. Denburg argued that the Railroad was negligent in that they failed to provide their workers with a safe work environment by equipping portions of the tunnel with ladders so that employees could get out of the way of oncoming trains. The Defendant contended that there were other ways of getting out of the tunnel. Mr. Denburg was successful in convincing a Hudson County jury to award Plaintiff $1.5 million.

1 million gross verdict against public entities for hand injury.

Mr. Denburg represented a client who was a pedestrian and struck by a hit and run motor vehicle. The incident was reported to both the local 911 dispatch and Police Departments. The responding Police Departments were unable to locate the victim and approximately 15 hours later he was found on the side of the road in the general area first reported. The client sustained a severe frost bite injury necessitating multiple injuries to his hand. Mr. Denburg argued that the 911 dispatcher was negligent for failure to obtain appropriate information from the caller and didn’t relay all of the appropriate information to the responding Police Departments to allow them to properly search the area. Furthermore, Mr. Denburg argued that the Police Departments were negligent for failure to perform a proper search of the area. Mr. Denburg was successful in convincing a Bergen County jury to award Plaintiff a gross verdict of $1 million.

The Defendant argued that the minor Plaintiff darted out between two parked cars and that the driver was not able to see her prior to impact. Mr. Denburg was successful in obtaining a settlement of $475,000.00 for his client.

$450,000 settlement for minor in the custody of State Agency who sustained eye injury.
